These Rental Terms, Conditions, and Liability Waiver (the “Agreement”) constitute a legally binding contract between you (the “Renter,” “you,” or “your”) and Akumal Scooters, including its owners, operators, affiliates, parent and subsidiary entities, officers, directors, members, managers, employees, independent contractors, agents, representatives, insurers, successors, and assigns (collectively, the “Released Parties” or “Akumal Scooters”).
You must read this entire Agreement before booking. By checking the agreement box, completing payment on akumalscooters.com, taking possession of a scooter, or signing this Agreement electronically or in writing, you acknowledge that you have read, understood, and voluntarily agreed to every provision below — including the assumption-of-risk, release, waiver, indemnification, and covenant-not-to-sue clauses, which limit your legal rights.

A $500 USD refundable security deposit is charged to your card at the time of booking. It is fully refunded within 2–5 business days after the scooter is returned in good condition with no damage, loss, or policy violations. The deposit may be applied in full or in part toward any fees described in Section 7.
By agreeing to these terms, you authorize Akumal Scooters to charge the card on file for any of the following:

Damage is assessed based on the condition at return compared to pickup. You will be contacted and given an opportunity to review any damage claim before your card is charged.
By completing your booking, you explicitly authorize Akumal Scooters to:
All charges will include an itemized explanation sent to your email. You will always have the opportunity to dispute a charge with evidence before it is processed.
The rental fee does not include any insurance covering injury to the renter, third parties, or property. You acknowledge that:
Read this section carefully. It limits your legal rights, including your right to recover damages for injury or death.
You understand and acknowledge that operating an electric scooter is a hazardous activity that carries inherent and unavoidable risks, including but not limited to:
You acknowledge that these risks may result in minor injury, serious bodily injury, permanent disability, paralysis, disfigurement, property damage, economic loss, or death, whether caused by your own actions, the actions or negligence of the Released Parties, the actions of third parties, the condition of the equipment, the condition of the roads or environment, or otherwise.
You expressly, knowingly, and voluntarily assume all risk of injury, death, loss, and damage arising out of or related in any way to your rental and use of the scooter, including risks that are not foreseeable and risks that may result from the ordinary negligence of the Released Parties, to the maximum extent permitted by applicable law.
To the maximum extent permitted by applicable law, you, on behalf of yourself, your spouse, heirs, next of kin, executors, administrators, personal representatives, beneficiaries, estate, and assigns, hereby release, waive, discharge, and covenant not to sue the Released Parties from and for any and all claims, demands, causes of action, suits, liabilities, judgments, settlements, damages, losses, costs, and expenses (including attorneys’ fees) of any kind or nature, whether known or unknown, foreseen or unforeseen, in law or in equity, arising out of or related in any way to:
This release does not apply to liability that cannot be waived as a matter of public policy under applicable law, including (where applicable) liability for gross negligence (culpa grave), willful misconduct (dolo), fraud, or intentional acts. The unenforceability of any portion of this release in any jurisdiction shall not affect the enforceability of the remainder.
You agree to defend, indemnify, and hold harmless the Released Parties from and against any and all third-party claims, suits, demands, judgments, liabilities, damages, fines, penalties, costs, and expenses (including reasonable attorneys’ fees and costs of defense) arising out of or relating to: (a) your operation, possession, or use of the scooter; (b) your breach of this Agreement; (c) your violation of any law or regulation; or (d) your negligent, reckless, or intentional acts or omissions. Akumal Scooters reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense.
You authorize Akumal Scooters and any first responders, emergency personnel, or medical providers to administer or arrange for emergency medical treatment, transport, and evacuation as they deem necessary. You agree that you, and not Akumal Scooters, are solely responsible for the cost of any such treatment, transport, or evacuation.
If any provision of Sections 11–13 is held invalid or unenforceable in any jurisdiction, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect. The release, waiver, indemnification, and covenant-not-to-sue obligations survive the termination or expiration of the rental.
This Section 12 governs all rentals taking place in Mexico and applies in addition to Section 11. A Spanish-language version of this Section 12 will be provided to and acknowledged by the Renter at pickup; both versions are equally binding, and in case of conflict the Spanish version controls for purposes of Mexican law.
You acknowledge that this rental is performed in the United Mexican States, in the State of Quintana Roo, and that this Agreement is governed by the substantive laws of Quintana Roo, Mexico, and, where applicable, the Federal Civil Code of Mexico (Código Civil Federal) and the Federal Consumer Protection Law (Ley Federal de Protección al Consumidor). You acknowledge that you have entered into this Agreement freely and with full understanding of its terms.
To the maximum extent permitted under Mexican law, you expressly waive (renuncia expresa) and release the Released Parties from any and all liability, claims, indemnities, or obligations to compensate (indemnizar) for damages, harm, or moral damages (daños, perjuicios y daño moral), whether direct, indirect, foreseeable, or unforeseeable, arising from or related to your use of the scooter, including any personal injury (lesiones), permanent disability (incapacidad), or death (fallecimiento), whether to yourself or, to the extent permitted, to your dependents, heirs, or successors.
Limitation: Nothing in this Agreement is intended to, nor shall it, waive liability for willful misconduct (dolo) or gross negligence (culpa grave) of the Released Parties, or for any other liability that cannot be waived as a matter of Mexican public policy. To the extent any provision is held to attempt such a waiver, it shall be reformed to the minimum extent necessary to be enforceable.
You expressly submit (se somete expresamente) to the jurisdiction of the competent courts of the City of Playa del Carmen, Solidaridad, Quintana Roo, Mexico, for the resolution of any dispute, controversy, or claim arising out of or related to this Agreement or your rental, and you expressly waive any other jurisdiction or venue (fuero) to which you may be entitled by reason of your present or future domicile or nationality.
You acknowledge that you have been informed of the price, terms, conditions, and risks of the rental in advance, and that you have voluntarily accepted them. Nothing in this Agreement limits any right you may have under the Ley Federal de Protección al Consumidor that cannot be waived by contract.
If you are a citizen or resident of the United States, or if you, your heirs, or your estate at any time seek to assert a claim in any court of the United States or any of its states or territories, this Section 13 applies in addition to Sections 11 and 12.
By agreeing to this Section 13, you expressly release the Released Parties from liability for their own negligence, to the maximum extent permitted by the applicable US state law.
You understand that this is a release of liability and a contract between you and the Released Parties, and you sign and accept it of your own free will. You further acknowledge that you have had a reasonable opportunity to read, ask questions about, and consult counsel regarding this Agreement before agreeing to it.
You expressly covenant and agree not to sue, file a complaint against, or initiate any arbitration, administrative proceeding, or other legal action against the Released Parties in any court or forum of the United States or any of its states, territories, or political subdivisions, for any claim released or waived under Sections 11–13. If you breach this covenant, you agree to reimburse the Released Parties for all costs, fees, and expenses, including reasonable attorneys’ fees, incurred in defending against the action.
You agree that the laws of the State of Quintana Roo, Mexico, govern the interpretation, validity, and enforcement of this Agreement, without regard to conflict-of-laws principles. You agree that the courts of Quintana Roo, Mexico, shall have exclusive jurisdiction over any dispute, and you waive any objection based on forum non conveniens, lack of personal jurisdiction, or improper venue. You consent to the dismissal or stay of any action filed in a US court in favor of proceedings in Quintana Roo.
To the maximum extent permitted by law, you waive any right to participate as a plaintiff or class member in any purported class, collective, consolidated, or representative action against the Released Parties.
If you are a California resident, or if California law applies to any portion of this Agreement, you expressly waive the protections of California Civil Code § 1542, which provides:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
You also waive any equivalent statutory or common-law protection in any other US jurisdiction.
You acknowledge that the laws of certain US states limit or prohibit pre-injury releases of liability for negligence in certain contexts. To the extent a court of competent jurisdiction determines that any provision of this Section 13 is unenforceable under the law of a particular state, that provision shall be enforced to the maximum extent permitted, and the remaining provisions shall remain in full force and effect.
You consent to receive this Agreement and all related communications electronically, and you agree that your electronic acceptance (including checking the agreement boxes and completing payment on akumalscooters.com) has the same legal effect as a handwritten signature. Akumal Scooters will retain a record of your acceptance, including timestamp, IP address, version of the Agreement accepted, and the contents of each acknowledgment, and you agree that this record is admissible as evidence of your acceptance.
This Agreement constitutes the entire understanding between you and Akumal Scooters concerning the rental and supersedes any prior or contemporaneous oral or written agreements. No modification, waiver, or amendment is effective unless in writing and signed by an authorized representative of Akumal Scooters. The failure of Akumal Scooters to enforce any provision shall not constitute a waiver of that or any other provision.
